Abstract:
With the growth of China’s urbanization, the scale of land use is being expanded and the pace of it is being accelerated simultaneously. However, some problems concerning the compensation of land use system have also come to light during this process. Since only by an array of measures such as solving the problems in agriculture (including countryside and farmers), protecting the interests of our peasants who make up the majority of china’s population and speeding up the development in urban and rural areas can we realize the new goals of socialist harmonious society that was put forward by the fourth plenary session of the 16th central committee of the CPC in time, this thesis considers it necessary and plausible to establish the land development rights by analyzing the core problem—compensation standard, which exists in the current system of land use compensation in china. With the aim of finding out a possible way for the related parts to allocate interests and to make choices, we analyze various kinds of views concerning the development fights in the “dynamic chess game” way with the help of the corresponding system in other countries and China’s current conditions. At last we conclude that firstly, it is obligatory to establish land development rights and development rights of the collective land in countryside should be consistent with the land ownership rights, which would allow farmers to participate in sharing the land development rights by setting up the guaranteed fund for farmers who lose their land. Secondly, the government should play its role as a reliable referee by withdrawing from the whole process in order to compensate the farmers for their lost land reasonably.
